Software License Agreements

URGENT! Please read before breaking disc seal
BEFORE YOU OPEN THE DISC ENVELOPE; PLEASE READ THE FOLLOWING CONDITIONS CAREFULLY. BE AWARE, THAT YOU AGREE WITH THE LISTED CONTRACT CONDITIONS; IF YOU OPEN THE DISC ENVELOPE. IF YOU DO NOT AGREE WITH THIS TERMS, SEND BACK THE WHOLE PACKAGE WITHIN TEN (10) DAYS FROM PURCHASING DATE. YOU WILL GET YOUR MONEY BACK.
In the following terms and conditions, "IWOXX Software Development, Dieter Woellner" will be called "IWOXX"! IWOXX grants you a license for using the program within Europe. The user has the responsibility for usage, installation and the results of using the program.

License rights
You are authorized,
  • to use the program on one single computer.
  • to copy the program into a computer readable form or printed version for backup purposes. This is allowed only to support the program usage. For some program parts this is forbidden. That parts have a copy protection implemented and contain a specific remark.
  • to change the program for usage on a single computer and/or to use it with other programs. For each program part used with another program, these license contract conditions are valid.
  • to hand out the program and license to a third person, if this person agrees to this license agreements. In that case you are liable, even to hand out all copies (computer readable or printed version) to this third person or to destroy all copies. This includes all modifications and program parts, which were integrated into other programs. Every copied or modified program part and every program part, that was integrated into other programs, must be marked with the copyright sign. The usage, copy, modify or transfer of the program, a copy of it or a program part, integrated into other programs is limited to these license agreements. If you should give away copies or modifications of this program or a program part, integrated into other programs, to a third person, the license is automatically invalid.

    Copyright
    THE SOFTWARE AND PRINTED MATERIAL ARE THE PROPERTY OF IWOXX AND ARE PROTECTED BY INTERNATIONAL AUTHORITY AND COPYRIGHT LAWS. THE BASE CONDITIONS FOR COPYRIGHT PROTECTED MATERIAL. THE PRINTED MATERIAL OF THIS SOFTWARE MUST NOT BE COPIED.

    License period
    The license contract is valid, until it gets canceled. You may cancel it at any time, by sending back or destroy the program with all copies, modifications and program parts, integrated into other programs and notify IWOXX in written form about the contract cancel. The license contract can be canceled, if one or more conditions of this contract are getting effective, breaking the copyright law or any other contract condition. IWOXX may cancel the contract, if the product is not payed by the user within ten days of notification. Even in this case, the user is engaged to destroy the program with all copies, modifications and other program parts, integrated into other programs.

    Limited warranty
    The program gets delivered in the passed format without any warranty for usability in any case or quality, neither in express nor implicit form. The licensee takes the risk of quality and achievement for this program. If there is a bug in the program, the user pays the arising expenses for service, repair or correction, not IWOXX or an authorized dealer. Claims related to legal regulations keep untouched. IWOXX grants no warranty, that the program properties satisfy any individual claim or that the software runs without any error or interruption. IWOXX grants warranty to the disc to be free of material or production errors for a period of 90 days from purchasing date (date on invoice) and to the hardware, delivered by IWOXX, to be free of material or production errors for a period of two years from purchasing date (date on invoice) at normal usage.

    Limited liability
    The liability of IWOXX and possible compensation is limited to the exchange of discs related to the limited warranty of IWOXX. Send the disc back to IWOXX or the authorized dealer with a copy of the invoice included. Further liability is excluded. This includes lost profit, data loss or other circumstances and damages as a result of using the software or third party compensation demands. This keeps its validity even if IWOXX or an authorized dealer was notified about such an event. Demands related to legal regulations for product liability keep untouched.

    Common terms
    The license may only be sub licensed or be handed over to a third person in the defined form. Any other form of the these defined rights, duties and terms be handed over is legally not effective. The defined agreements are under the law of Germany. If one of the terms is invalidated by law, it must be handled separately and has no affect to validity or use of the other terms. For questions on this contract, please contact IWOXX or an authorized dealer. If you break the disc package seal and open the disc envelope, you confirm the knowledge and agreement of these contract conditions. Further you agree, that this is the only and complete agreement between the manufacturer and customer, invalidating all previous agreements (written or verbal) and other information exchanges related to this license agreements.
